Florida DMV Points Suspension Attorney
It is a serious criminal offense to drive when your Florida driver’s license has been suspended or revoked. But many people charged with this crime are unaware, until too late, that they are under suspension based on an accumulation of traffic offenses.
If you are facing a points suspension or accused of Driving While License Suspended (DWLS), the experienced attorneys of Ferrer Shane, PL, can step in to fight for you. We can address the underlying reasons for suspension and intervene to try to preserve your driving privileges and avoid any penalties.
We handle traffic infractions and criminal traffic offenses in Miami-Dade County and throughout South Florida. Contact us today for a free initial consultation.
Points Suspension of Your Florida License
A conviction for a major offense, such as DUI or reckless driving, can result in automatic license suspension. But your license can also be suspended under Florida’s points system. Any combination of serious moving violations or minor infractions can put you over the threshold:
- 12 points within 12 months: 30-day suspension
- 18 points within 18 months: six-month suspension
- 24 points within 36 months: one-year suspension
For this and other reasons, it is prudent and important to fight any traffic ticket. Your current offense — or the next one — could take away your license.
Driving After a Points Suspension
Perhaps you received a couple of citations in a short period. Perhaps you did not even know you had broken a traffic law, such as SunPass toll violation. Maybe you did not receive notice of the traffic ticket because you moved recently. Or maybe you paid a ticket without realizing that the points would trigger an administrative suspension.
The punishment for DWLS can include jail time, steep fines, and extended suspension/revocation of your license. Florida law does differentiate between knowingly and unknowingly driving on a suspended license. However, you will need a skilled attorney to convince the court to give you the benefit of the doubt.
Our attorneys are skilled at revisiting the underlying points violations to get them dismissed or reduced to avoid DWLS charges and we have helped many clients obtain a D-6 clearance to restore a suspended license.
