Miami Red Light Camera Attorney

Thousands of Florida drivers have received citations for running a red light even though no police officer observed an infraction or pulled them over. The tickets arrive in the mail, based on digital photos of license plates taken at intersections by a robotic camera.

As of July 10, 2010, under legislation signed by Gov. Christ, red light camera tickets are “legal” again in Florida. But if you received such a citation in the mail, you should strongly consider fighting it. There are pending legal challenges to the constitutionality of red light cameras, and simply paying the ticket has consequences for your wallet and your driving privileges.

The traffic violation defense lawyers of Ferrer & Gonzalez, PL, will explain your rights and options in a free consultation. We practice in traffic courts of Miami-Dade County and surrounding jurisdictions of South Florida everyday. Contact us today.

Red Light Camera Violations

Under the new law, violators are fined $158 for each offense of running a red light at an intersection with a red light camera. The traffic infraction carries no points against your license, but your license can be suspended if you fail to pay the ticket within 30 days. The infraction can also hamper your ability to register your car or secure a new license plate, and your insurance provider could use the citation to raise your rates.

A common problem is that drivers do not receive a notice of the ticket in a timely fashion or do not receive it at all. Some clients were unaware of the violation until the Florida Department of Highway Safety and Motor Vehicles had initiated a D-6 administrative license suspension.

Another main problem is that the ticket is issued to the car and not the driver — even if a spouse, son or daughter was driving, the registered owner is on the hook for the ticket.

Our attorneys can determine if there is a basis for fighting your ticket. Many Florida counties have shortened yellow lights in violation of state law in order to catch more drivers with red light cameras. Failure to come to a complete stop can trigger a violation. In some cases, the DMV has falsely issued tickets to the wrong license plate.
